These Terms of Use (“Terms”) govern your use of Publication Planner (the “Tool”), a free flat-planning tool provided by The Ethical Agency at publication-planner.ethical-agency.com. By using the Tool, you agree to these Terms. If you do not agree, please do not use the Tool.

1. Who provides the Tool

The Tool is provided by The Ethical Agency (South Africa, reg. no. 2019/495067/07) (“The Ethical Agency”, “we”, “us”). Contact: hello@ethical-agency.com.

2. The Tool is free and provided “as is”

We offer the Tool free of charge as a goodwill service. It is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, or uninterrupted availability, to the fullest extent permitted by law.

3. Your account and responsibilities

You are responsible for activity under your account and for keeping access to your sign-in email secure.
You must use the Tool lawfully and not misuse it (e.g. no attempts to disrupt, reverse-engineer, overload, or gain unauthorised access to the service or other users’ data).
You must have the right to use any content – including images – you upload, and must not upload anything unlawful, infringing, or harmful.

4. Your content and intellectual property

You keep all rights in the flat plans and content you create. You grant us only the limited permission needed to host, store, process, and display that content so the Tool can function for you (for example, saving your work and showing a plan via a share link you generate). We do not claim ownership of your plans.

The Tool itself – its software, design, and branding – belongs to The Ethical Agency.

5. Sharing links

If you create a “share” link or send a plan to us, anyone with that link can view (but not edit) the plan. You are responsible for who you share links with. Do not include confidential information you are not entitled to share.

6. Availability, changes, and your backups

We may change, suspend, or discontinue the Tool, in whole or in part, at any time and without notice. We may also set or change limits, or remove content, where reasonably necessary. We do not guarantee that your data will be retained or recoverable, so please keep your own backups – the Tool includes an “Export” function for this purpose.

7. Limitation of liability

To the fullest extent permitted by law, The Ethical Agency will not be liable for any indirect, incidental, special, or consequential loss, or for any loss of data, profits, or business, arising from your use of (or inability to use) the Tool. Nothing in these Terms excludes liability that cannot lawfully be excluded. Where liability cannot be excluded, it is limited to the maximum extent permitted by applicable law.

8. Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

9. Governing law

These Terms are governed by the laws of the Republic of South Africa, without limiting any mandatory consumer or data-protection rights you may have in your country of residence (including the United Kingdom/EU). Disputes will be subject to the non-exclusive jurisdiction of the South African courts.

10. Changes to these Terms

We may update these Terms from time to time. The current version will always be posted here with the “last updated” date.
